New EPR Requirements for E-commerce

Article 178-quater of the Environmental Code, introduced by Article 14-ter of Decree-Law 131/2024 (“Urgent Provisions for the Implementation of Obligations Arising from European Union Acts and Pending Infringement and Pre-Infringement Procedures against the Italian State”), converted by Law No. 166/2024, has established new procedures for fulfilling Extended Producer Responsibility (EPR) obligations in the context of e-commerce.


The provision imposes on producers placing products on the market through e-commerce platforms the obligation to comply with EPR requirements, introducing new compliance procedures for online sales. These procedures will be defined through program agreements to be concluded between marketplaces and Consortia. The deadline for the signing of agreements between platform operators and consortia or management systems is 120 days from the date of entry into force of the provision.
